PoolParty Terms of Service
Public beta · version beta-1 · last updated 2026-10-01
These terms are between you and PoolParty Labs LLC, a Colorado limited liability company (“we”, “us”, “our”). They cover poolpartyai.com and the online services we run for PoolParty (the “Services”). The PoolParty software itself is covered by the End User Licence Agreement. Our Privacy Notice, the website’s own Privacy page and our Credits Terms explain the rest.
The short version
This summary is here to help you read the terms. The full text below is what governs.
- The Services are a free public beta. They may change, slow down, break or stop at any time.
- Keep your credentials and join codes secret. What happens under them is your responsibility.
- Follow the Acceptable Use rules below. No illegal content, no attacks, no abuse of other people’s machines.
- What is yours stays yours. We cannot read your sealed files, and we do not train AI on your content.
- Nothing costs money unless you have agreed to a price first.
- The same beta disclaimers and liability limits apply as in the End User Licence Agreement.
1. Accepting these terms
1.1 You accept these terms by using the Services. If you do not agree, do not use them.
1.2 You must be at least 18 years old, or the age of majority where you live if that is higher, to use the Services.
1.3 If you use the Services for a company or other organisation, you confirm that you have authority to bind it, and “you” includes it.
2. The Services
2.1 Today the Services are this website; the download and update service that delivers PoolParty, its signed update information, the model list, the signed stop and The Public Pool’s join document; and our support mailbox.
2.2 Some services are not open yet: the diagnostics service that receives reports you choose to send, The Public Pool, the PoolParty account, joining devices from outside your home network through our servers, relays for rooms and away access, and connecting AI apps to your pool through our servers. When each one opens, these terms cover it, together with anything we publish about it at that time.
2.3 The Services are a beta, offered for testing. They may change, be limited, be interrupted or be discontinued at any time, with or without notice. There is no service-level commitment. We may set limits on use, and we may restrict access to protect the Services or other people.
3. Credentials, codes and keys
3.1 PoolParty uses device credentials, passkeys, join codes and keys instead of passwords. They are secrets. Keep them private, give a join code only to the device or person you mean to admit, and revoke anything you think has leaked.
3.2 Depending on your settings, anyone who holds an unused long join code may be able to join your pool with it.
3.3 You are responsible for activity under your credentials. We may revoke or refuse any credential that reaches our Services if we reasonably believe it is compromised or misused.
4. Acceptable use
You may not use PoolParty or the Services to:
a. break any law or regulation, or help anyone else do so;
b. create, store, share or process sexual content involving minors, which we report where the law requires;
c. infringe anyone’s intellectual property, privacy or other rights, or process other people’s personal data without a lawful basis;
d. harass, threaten, defraud or deceive anyone, or impersonate any person or organisation;
e. create, spread or run malware, or gain or try to gain unauthorised access to any device, account, network or data;
f. probe, scan, overload or attack our Services or anyone else’s systems, or interfere with other people’s use of them;
g. bypass or tamper with sandboxes, limits, consent controls, budgets, rate limits, credits or metering;
h. use The Public Pool for anything other than the work it offers, such as mining cryptocurrency;
i. break the licence or use policy of a model, engine, game or other third-party component;
j. design, develop or operate weapons, or run anything where a failure could cause death, injury or serious damage to property or the environment;
k. send spam, or scrape or copy the Services in bulk; or
l. help anyone do any of these things.
We may investigate suspected breaches, remove content from or block access to the Services, and cooperate with the authorities where the law requires or allows.
5. Your content
5.1 You keep ownership of what you send through the Services.
5.2 You give us permission to host, copy, transmit and process it only as far as we need to run the Services for you, and for no other purpose.
5.3 We do not use your content to train AI models, and we do not sell it.
5.4 Most of what PoolParty handles never reaches us. Your prompts, answers and files stay in your pool, or in the pool you ask, unless you connect a service that sends them elsewhere, and sealed files stay encrypted with keys that only your devices hold. The Privacy Notice explains what does reach us.
5.5 You are responsible for your content, and you confirm that you have the right to use it.
6. The Public Pool
6.1 These rules apply once The Public Pool is open. Joining it is always your choice.
6.2 A machine in The Public Pool runs only the signed, sandboxed work The Public Pool offers, within the limits PoolParty posts, and that work always gives way to your own pool’s work. Your own limits apply too, whichever are stricter.
6.3 You can leave at any time. We may remove any machine or stop any work at any time, including to protect the Services or other people.
6.4 Taking part creates no employment, agency, partnership or payment relationship. We do not promise any amount of work or credits. Credits are governed by the Credits Terms and are never paid out.
7. Fees
The beta is free. If we introduce anything that costs money, we will show you the price and ask you to agree before you are charged. We will never charge you without your agreement.
8. Other people’s services
The Services rely on, and PoolParty can connect to, services run by others. For example, Cloudflare carries our traffic, Hugging Face hosts the models in PoolParty’s catalog, AgentMail hosts our mailbox, and an assistant built on Anthropic’s Claude reads it first; you may also connect engines, stores and apps of your own choosing. Their terms and privacy policies apply to them. We are not responsible for them.
9. Suspension and ending
9.1 You may stop using the Services at any time.
9.2 We may suspend or end your access to the Services if you break these terms, if we need to in order to protect the Services or other people, if the law requires it, or if we end the beta.
9.3 Sections 4, 5.2 to 5.5, 6.4 and 10 to 15 continue to apply after your access ends.
10. No warranty
THE SERVICES ARE A BETA, PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS, AND YOU USE THEM AT YOUR OWN RISK. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING THOSE OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICES WILL BE AVAILABLE, UNINTERRUPTED, SECURE OR FREE OF ERRORS OR HARMFUL COMPONENTS.
11. Limits on our liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, BUSINESS OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM AND (B) US$50.
This limit and the one in the End User Licence Agreement are a single combined limit, not two. These limits apply whatever the legal theory, and even if a remedy fails of its essential purpose.
12. Your responsibility to us
To the extent the law allows, you will defend and indemnify us, and hold us harmless, against third-party claims, and the resulting losses and reasonable costs, arising from your breach of these terms, your breaking the law or infringing someone’s rights, or your content.
13. Changes to these terms
We may change these terms. Each version carries a version name and a date, and the current one is published at poolpartyai.com/terms. If a change is material, we will show it on the website or in the app before it takes effect, and the app asks you to accept it. If you keep using the Services after it takes effect, you accept the change; if you do not agree, stop using them.
14. Law, disputes and the rights the law gives you
Section 18 of the End User Licence Agreement (rights the law gives you) applies to sections 10 to 12 of these terms, and its section 22 (law and disputes) applies to these terms, in each case as if written here, with “these terms” in place of “this agreement”.
15. General
Sections 23.2 to 23.8 of the End User Licence Agreement apply to these terms as if they were written here, with “these terms” in place of “this agreement”. These terms, together with the End User Licence Agreement, the Credits Terms and the documents they refer to, are the whole agreement between you and us about the Services. If these terms and the End User Licence Agreement conflict about the Services, these terms govern.
16. Reporting a problem
Report abuse, a security problem, or content you believe infringes your rights to hello@poolpartyai.com. Legal notices, deletion and privacy requests, security reports and copyright complaints always go to a person.
